Class Action Waiver: You and sükí agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and sükí each waive any right to a jury trial.
Arbitration Rules: The arbitration will be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA) or JAMS, as selected by the party initiating arbitration. The arbitration will be conducted in California, United States.
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms of Use will be brought exclusively in the federal or state courts located in California, and you hereby irrevocably consent to the personal jurisdiction and venue therein.
If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Use shall otherwise remain in full force and effect and enforceable.
These Terms of Use, together with our Privacy Policy, Acceptable Use Policy, and any other legal notices published by us on the website, shall constitute the entire agreement between you and sükí concerning the website and services.
We may modify these Terms of Use at any time. When we make material changes, we'll notify you via email or a prominent notice on our platform. Continued use of sükí after changes constitutes acceptance of the updated terms.
